  • Overall it seems that the process of getting an H-1B visa will be more relaxed.
  • H-1B visa program ban is not in sight anymore which became quite apparent last year under the ruling of the previous party along with the Coronavirus outbreak.
  • The denials were random and rampant during the previous administration as the ideology of enforcing the ‘Buy American, Hire American’ policy was given primary preference. The department asked for more information in the shape of RFE’s which in-turn made the candidates qualify for the visa enormously difficult.
  • USCIS envisioned prioritizing the economic interests of American workers and ensuring that only highly skilled foreign workers benefit from the temporary employment program. However, now the agency is delaying the rule’s effective date until December 31, 2021, as per its latest statement.

3. Timeline for H-1B Registration

  1. The window was opened for registration on the March 9th, 2021
  2. The deadline for the registration process is March 25th, 2021
  3. The notification of the selected candidates will happen on the 31st March 2021
  4. The petition may begin taking place for the FY 2022 H-1B cap by the April 1st, 2021
